ORDINANCE NO. 9452 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 6214 HIXSON PIKE, BEING ON THE SOUTHEAST LINE OF HIXSON PIKE SOUTHWEST OF BIG RIDGE ROAD FROM R-4 SPECIAL ZONE TO C-2 CONVENIENCE COMMERCIAL DISTRICT, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 6214 Hixson Pike being on the southeast line of Hixson Pike southwest of Big Ridge Road. An unplatted tract beginning on the southeast line of Hixson Pike some 705 feet southwest of the intersection of the southeast line of Hixson Pike with the southwest line of Big Ridge Road, thence southeast 300 feet, thence northeast some 163 feet, thence southeast some 400 feet to a point 700 feet (if measured at a right angle) southeast of the southeast line of Hixson Pike, thence southwest some 790 feet parallel to, and at all points 700 feet southeast of, the southeast line of Hixson Pike, thence northwest some 272 feet, thence northeast 186.98 feet, thence northwest 430.7 feet to the southeast line of Hixson Pike, thence northeast some 450 feet with Hixson Pike to the point of beginning, said tract being a part of the property described in deed book 3093, page 543, R.O.H.C. Tax Map No. 101-19.1. from R-4 Special Zone to C-2 Convenience Commercial District. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. The owner of said tract shall dedicate to the City enough right-of-way along full frontage of property along Hixson Pike to establish 52' wide right-of-way from the existing centerline of Hixson Pike to the western boundary of the owner's property; said owner shall build curb and roadway to a point 44' from the existing centerline of Hixson Pike along full frontage of property; said owner shall build part of left turn lane as required by City Traffic Engineer on the west side of Hixson Pike centerline for length of property frontage only; said owner shall build 300' tapers back to existing roadway on both sides of left turn bay; all of the afore listed items plus location of access points shall be subject to acceptance and approval by the City Engineer and City Traffic Engineer. 10. All existing easements are retained. 0C SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it, provided that this Ordinance shall not be operative until the applicant has complied with the provisions of condition no. 1 in Section 2 above.
